The Pennsylvania Constitution

The State of Pennsylvania's Constitution is known to grant its citizens more personal Rights than the Federal Constitution. For instance, 'inalienable rights,' mentioned in our countries Declaration of Independence, is not protected in our countries Constitution; however, 'inalienable rights' are enshrined in our Pennsylvania Constitution's Declaration of Rights.

Article 1, Section 1 of our Pennsylvania Constitution is entitled 'INHERENT RIGHTS OF MANKIND' and reads:

Section 1 - INHERENT RIGHTS OF MANKIND

"All men are born equally free and independent and have certain and indefeasible rights, among which are those of enjoying and defending life and liberty, of acquiring, possessing and protecting property and reputation, and of pursuing their own happiness."

The most important words here are:

  1. INHERENT RIGHTS - by definition the same as 'inalienable rights'
  2. Among which - means following are some but not all our INHERENT RIGHTS
  3. Indefeasible - claim or right not vulnerable to being defeated, revoked or lost

INHERENT RIGHTS are rights we inherit from the people alive before us. Being indefeasible, they are constitutionally guaranteed against being defeated by legislation, revoked by law, or lost because time passes during which the rights were not exercised.

Within the term "among which" exist the INHERENT RIGHTS OF MANKIND. As a citizen of Pennsylvania we '...have certain and indefeasible rights, among which is the right to treat ourselves medicinally with what we find comforts, eases and/or cures our pains and sufferings from the ailments inflicting us...'

As citizens of Pennsylvania we do not need the governments permission to treat ourselves with substances we find have medicinal benefit. It is our Constitutional Right.

Admittedly, this legal argument has yet to be ruled on by the state Supreme Court. It just has not yet come up; however, a few of us intend on being arrested to press the Supreme Court acknowledge this fundamental right.

Under our Federalist system of Republic Governance, the rights guaranteed us by our Pennsylvania Constitution supercede Federal laws.

The government of Pennsylvania – Executive, Legislative and Judicial - are sworn to protect our Constitutional Rights from being violated, and to protect our 'reputaions' while we are 'pursuing our own happiness.'

Our Pennsylvania legislators have the Constitutional Duty and Obligation to pass laws protecting our lives and reputations from both State and Federal criminalization for practicing our INHERENT AND INDEFEASIBLE CONSTITUTIONAL RIGHT to treat ourselves medicinally with marijuana.

For thousands of years people have enjoyed the medicinal benefits of marihuana. Records from our countries founding fathers estates supply ample evidence that they grew hemp not only as a textile product but also for medicine. In 1972, in this country, it was legal to treat oneself medicinally with marihuana. Just because they changed the spelling from "marihuana" to "marijuana" does not mean we lost the right to treat ourselves with marijuana today.

IT IS THE DUTY AND OBLIGATION ACCORDING TO THEIR OATH OF OFFICE FOR THE PENNSYLVANIA LEGISLATIVE BODIES TO PASS LAW DECRIMINALIZING WE THE PEOPLE OF PENNSYLVANIAS CONSTITUTIONALLY PROTECTED RIGHT TO THE USE OF MARIJUANA FOR MEDICINAL PURPOSES.

IT IS THE DUTY AND OBLIGATION ACCORDING TO THEIR OATH OF OFFICE FOR THE JUDICIARY OF PENNSYLVANIA TO RULE AGAINST ANY AND ALL LAWS INFRINGING UPON THE RIGHT OF WE THE PEOPLE TO TREAT OURSELVES MEDICINALLY WITH MARIJUANA BE SAID LAW STATE OR FEDERAL.

IT IS THE DUTY AND OBLIGATION OF PENNSYLVANIAS EXECUTIVE BRANCH OF GOVERNMENT TO PROTECT PENNSYLVANIAS STATE SOVERIEGNTY BY PROTECTING OUR CONSTITUTIONAL RIGHTS FROM FEDERAL USURPTION.
